Congress IT chief arrested for tweeting fake exit poll.

City crime branch Cyber cell has registered a case against Rohan Gupta, the convener of Congress’s Gujarat IT cell, for sharing an opinion poll after voting for the first phase of Gujarat assembly elections was held on December 9.

Gupta said he will take legal action. “It’s a false case. It’s not exit poll, but it’s just an opinion poll. I will file legal complaint. BJP is in frustrations after sensing defeat. In Rajya Sabha elections also, they tried all such tricks but we will not stop fighting,” he said.

Crime branch sources said that on the directions of the election commission (EC) they have booked Gupta for offences under Section 188 and Section 171 (g) of IPC for violating the EC prohibition on exhibiting opinion polls till the second phase of the election was over. The second phase of voting will be held on December 14.

“We have also applied Section 126(1) and 127(a) of the People’s Representation Act against the accused for violating norms of the EC,” said a crime branch official.

According to the complaint, the in-charge of election legal cell of state BJP, Parindu Bhagat, had lodged a complaint with the state EC that the convener of the IT cell of Congress, Rohan Gupta, had shared a fake exit poll from his Twitter account violating the norms of the EC.

Officials of city crime branch said that according to the directions of the EC they have registered a complaint and a detailed probe report will be sent to the Ahmedabad city police commissioner.
