‘Triple talaq’ worst form of marriage dissolution says Supreme Court

The Supreme Court today said that triple talaq is the ‘worst and undesirable form’ of dissolution of marriage in the Muslim community.

Senior lawyer Ram Jethmalani called triple talaq ‘abhorrent’, it doesn’t give women equal right to divorce.

Jethmalani told the court that it is a breach of Article 14 of the Indian Constitution. Triple talaq is a method of terminating a marriage contract, the power for which lies with men, not with women.

However, the court also observed that different schools of also thought Islam term it as a ‘legal’ action.

Maintaining the stand, the Centre on Thursday told the Supreme Court that it opposes the system and wants to fight for women equality and gender justice.

However, All India Muslim Personal Law Board (AIMPLB) counsel Kapil Sibal told court that it falls under the Muslim board

“The Central Government makes rules but in my opinion, the Supreme Court should not interfere with it,” Sibal said.

The Supreme Court is hearing several pleas filed by Muslim women rejecting the practice of triple talaq.
