High Court pronounces verdict for wife’s rape charge against husband….

The High Court has recently put an end to a criminal case after it came to know that a man and his wife reached a compromise and have begun to live together after they fought badly accusing each other of being in illicit relationship.

The petitioner, husband in this case, had requested the Gujrat HC to quash the charges of rape, beating, domestic violence, criminal intimidation and cheating levelled against him by his wife. The woman had also accused another woman living next door that she was prompting her husband to commit cruelty on her.

The wife levelled weird charges against her husband before Halvad police in Morbi district in 2015.

Preliminary investigation revealed that it was a case of wife swapping as two couples living next-door entered into illicit relationship. After a few months, one couple fell apart leading the wife to register an FIR against her husband and neighbour’s wife.

The accused persons – the husband and neighbour’s wife – approached the high court in 2015 for quashing of the FIR on the ground that the allegations were levelled after his relationship with his wife became sour due to the illicit relationships involving both the couples.

After filing the petition, the petitioners did not turn up for hearing. Even the complainant too did not pursue her complaint before the police. The case remained pending for two years. Last month, the high court asked the investigator to find out the status of the petitioners and the complainant.

On inquiry, police found out that both the couples vacated their houses. The complainant and her husband have settled in a nearby village and they have reached a compromise. When the court was informed about the present situation, Justice J B Pardiwala consulted with the lawyers and quashed the FIR filed by the woman with Halvad police station, said petitioners’ advocate Virat Popat.
