PNB Fraud Case: CBI Fined for Arresting a Woman After Sunset

Kavita Manikkar , an executive assistant to Nirav Modi and his group firms’ authorised secretary , had signed a lot of papers without knowing the ramifications of her actions. As a result, she ended up in jail along with five others in connection with the Rs 11400 crores’ PNB fraud case. But Bombay High court in Wednesday held the arrest of Kavita Manikkar as illegal and ordered the agency to pay a fine of Rs 50000 in eight weeks.

The order was passed by a Division bench if Justice S J Kathawalla and justice Bharati Dangre and was made available on the HC website on Wednesday. Kavita Manikkars advocate Yash Wardha Tiwarib said her client was arrested kn February 20 2018 by CBI to investigate her role in the PNB scam. He said the agency violated rules of criminal procedure by arresting her after sunset and requested the court to order action against erring officers. The court said “the arrest was illegal and in violation of and utter disregard to Section 46 (4) of the Cr.PC. The CBI is liable for disciplinary proceedings “.

The court ordered CBI to pay a cost of Rs 50000 to Kavita Manikkar within eight weeks and asked the agency to recover the Money from the erring officers who carried were behind the arrest.
