Nikah Halala… To be or not to be..?

Nikhah halala a practice among certain sects of Sunni Muslims, which involves a female divorcee marrying someone else, consummating the marriage and then divorcing in order to remarry her previous husband, has long been caught in controversy, as many dub it as a heinous practice that goes against one’s morale.

In a shocking report, it is said that a number of Muslim scholars are trying to take advantage of this law by offering themselves up for one-night stands with divorced Muslim women trying to save their marriages.

The Imams offer one night stands to divorce woman where they charge woman anywhere between Rs 20,000 and Rs 1.5 lakh, for ‘Nikah halala’.

It was found many Islamic scholars putting themselves up on sale for women desperate to restore their broken marriages.

In the investigation, the reporters met an Imam Mohammed Nadeem at a restaurant in Hyderabad, who is willingly offering himself to spend a night with a woman to save her marriage. He said that though he is married, his wife knew this practice he is in, and never objected.

The Imam also admitted he had officiated several nikah halala marriages before. He was heard asking a fee of Rs. 1 lakh for this Nikah halala.

It was found that this business is flourishing and is widespread.

Another Muslim Scholar from Delhi, Zubair Qasmi, boasted that he has two wives and is ready to nominate himself to be the husband of the third one for a one night stand with her at the prospect of Nikah halala, in exchange for money.

Also for certain Nikah halala to be performed even a formal marriage is not required. Where they ask in return is a donation for their madrassa for the ‘service’ they provide.

Certain Imamas are ready to provide men from their madrassas for the service of Nikha Halala if the Imams were unable to attend.

This shocking expose have made political leaders from all sects rising above their political differences, and demanded that the perpetrators should be prosecuted for rape.

Zafar Sareshwala, chancellor of the Maulana Azad National Urdu University, blamed personal laws for certain regressive practices in Islam. “I think the genesis of the problem lies in the Shariat Act of 1937,” he insisted. Authors of the personal laws, he added, had been “millions of miles away” from the teachings of Islam.

BJP spokesman Gaurav Bhatia, himself a lawyer, underscored the need for abolishing nikah halala like the sati practice in Hinduism. “Nikah halala and polygamy, as triple talaq are regressive. Sati is abolished. So should be these practices,” he said.
