Prosecution arguments continue in Kathua rape-murder case

On the second day of the trial at Pathankot Judicial Court Complex on Friday, the prosecution continued its arguments on framing charges against the seven accused. The hearing will resume at 1:30 PM Saturday.

The Defence counsel on Friday had filed their objections to the prosecution application which sought directions to keep the accused in Pathankot District Jail during the trial.

Defense Counsel A.K.Sawney told the Indian Express that the Pathankot Sessions Court did not have the authority to order the interstate transfer of prisoners and that there was no direction for it from the Supreme Court. Sawney added,“We have also said that the prisoner rights will be infringed due to the transfer and also there are financial complications involved in the transfer,”.

The prosecution had summed up the case before the District and Sessions Judge Dr. Tejwinder Singh. The Defence counsel objected to the Prosecution submissions arguing that the documents on the information about evidence had not been translated yet.

Advocate Vinod Mahajan, one of the defense counsels from Pathankot said that the arguments on charges would resume on Saturday at 1:30 PM.

The Sessions Court directed the Prosecution to complete the translation of all the case files including the charge sheet before June 4 and provide the copies of the same to the defense counsels. Having the majority of the documents being translated, the process is likely to complete on Monday.

The Supreme Court had shifted the trial from the Kathua District Court to Pathankot on May 7. The Judge presiding over the case has already told the Defence as well as the Prosecution to keep at least 5 witnesses on standby on each hearing for the sake of examination after the charges are framed.
