Triple talaq: SC to announce final judgement today

The Supreme Court will announce its final verdict on a series of pleas challenging the constitutional validity of the practice of triple talaq today

The five-judge Constitution Bench headed by Chief Justice JS Khehar, that has been holding marathon hearings on the petitions, had reserved its verdict on May 18.

During the hearing, the Supreme Court had said that while it will be currently only deciding on the issue of ‘triple talaq’ due to the paucity of time, it will be keeping open for adjudication the issues of polygamy and ‘nikah halala’ to be dealt within the future.

The court had also observed that that triple talaq is the “worst” form of dissolution of marriage among Muslims.

The remark was made by the bench when senior lawyer Salman Khurshid referred to the various schools of thought and the stand of All India Muslim Personal Law Board that triple talaq was “abhorrent”, yet valid.

The period of Iddat, that is mandatory during triple talaq has been completely overlooked in multiple cases. While several Muslim groups claim to despise the practice of triple talaq in general and ‘instant triple talaq’ in particular, they argue that it’s a matter of Islamic law.

The Muslim women, who had filed the petitions, have challenged the practice of triple talaq in which the husband, quite often, pronounces talaq thrice in one go, sometimes even on phone or via text message.
